⚖️ One council seat, two courts, $207,000 — the Spadola fight is headed to Delaware's Supreme Court.
Council President Ernest "Trippi" Congo and the council have appealed the Chancery Court ruling that blocked them from removing at-large Councilman James Spadola, who switched from Republican to Democrat in September 2025. In May it voted to declare the seat vacant, arguing the charter protects minority-party representation.
Chancellor Kathaleen McCormick ruled in September that the charter doesn't restrict post-election party switches, and the council exceeded its authority. The council says it remains "firmly convinced" the charter prohibits it; its fast-track request was denied October 14. Opening brief is due Nov. 30.
The city's legal bill tops $207,000 — $130,000 of it paid to Spadola's own lawyers. He has called an appeal a waste of resources.
